Lotocki's appeal against disqualification from practicing medicine was dismissed

The Supreme Court of Justice rejected an appeal by Aníbal Lotocki against the sentence that declared his disqualification from practicing the medical profession after being sentenced to four years in prison for serious injuries, judicial sources reported. In 2022, Lotocki was sentenced by the Oral Criminal and Correctional Court No. 28 of the Federal Capital to four years in prison, and five years of special disqualification from practicing medicine, as the author of the crime of serious injuries repeated in four facts, but acquitted him of the crime of fraud. Chamber III of the National Chamber of Cassation in Criminal and Correctional Matters revoked one of the points of the sentencing sentence and imposed "the disqualification from practicing the profession of doctor, on a precautionary basis, until his situation is definitively resolved." in this case." It was against this decision that Lotocki's private defense filed an extraordinary appeal that was declared inadmissible, which led to the filing of a complaint before the Supreme Court. On October 18, Lotocki was arrested for the death of Zárate after turning himself in in La Plata following an order issued by the Crime Chamber. The highest court, with the signature of Horacio Rosatti, Carlos Rosenkrantz, Juan Carlos Maqueda and Ricardo Lorenzetti, rejected the claim for not having complied with the requirements established in art. 7°, section c, of the regulations approved by the agreed 4/2007. On Tuesday, prosecutor Pablo Recchini requested that Lotocki be brought to trial in the investigation into the simple homicide with possible intent of the patient Rodolfo Christian Zárate, which occurred in 2021 after complications derived from a surgical intervention, for which the doctor is in prison. .
